These Terms of Use (“Terms”) apply to your access to and use of TheFutureMe websites, tools, and services, including our wellness score/assessment, templates and digital products, accounts, community features, and optional coach matching or 1-on-1 services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility and age
You must be 16 years or older to use the Services.
If you are under the legal age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf (where required by local law).
2) Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via a website notice or email). Your continued use of the Services after updates means you accept the updated Terms.
3) Accounts and security
Some features require an account.
You agree to:
Provide accurate and complete information.
Keep your login details confidential.
Notify us promptly if you suspect unauthorised access to your account.
You are responsible for all activity under your account unless caused by our failure to maintain reasonable security.
4) What we provide
TFM provides systems-first wellness tools that may include:
Wellness score/assessment outputs and recommendations
Templates and digital products
Email onboarding and newsletters (where you opt in)
Coach/trainer directory, matching, and 1-on-1 services (where available)
Community or group features (where available)
Features may change, be paused, or be discontinued as we improve the Services.
5) Not medical advice
TFM is for general information, education, and habit support only.
We are not a medical provider. Nothing in the Services is medical advice, diagnosis, or treatment. Always seek advice from a qualified healthcare professional regarding any medical concerns, injuries, conditions, medications, or before starting a new exercise or nutrition programme.
If you believe you may be experiencing a medical emergency, contact local emergency services immediately.
6) Your responsibilities and safety
You are responsible for:
Your own health decisions, training intensity, and food choices
Ensuring you are medically fit to participate in any activity
Using the Services in a safe manner
Do not use the Services in a way that could cause harm to yourself or others.
7) Coach matching and third-party services
Where we offer coach matching, directory listings, or 1-on-1 services:
TFM may help you discover and connect with independent coaches/trainers (“Coaches”).
Coaches are independent third parties and are not our employees, agents, or partners unless we explicitly say so.
We do not guarantee any specific outcomes, results, or suitability of a Coach.
Any advice or services you receive from a Coach are provided by that Coach, not by TFM.
You are responsible for verifying a Coach’s qualifications and deciding whether to work with them.
Payments for coaching: If coaching payments are handled via third-party payment providers, those payments are subject to the provider’s terms and policies. TFM is not responsible for payment provider failures, chargebacks, or disputes beyond what we are legally required to handle.
8) Paid products, subscriptions, and payments
Some Services are paid (for example templates, digital products, premium access, or subscriptions).
Pricing and taxes
Prices are shown at checkout and may change over time.
Taxes may apply depending on your location and the payment provider’s requirements.
Payment processing
Payments are processed by third-party payment providers (for example PayFast, Paystack, Stripe, PayPal, or others we choose). We do not store full card details on our systems.
Subscriptions
If you purchase a subscription:
It may renew automatically unless cancelled before the renewal date (where applicable).
You are responsible for managing cancellations via your account or the payment provider flow.
Refunds (case-by-case)
Refund requests will be investigated, and the outcome will be determined on a case-by-case basis, taking into account:
The nature of the product/service purchased
Whether digital content was accessed or delivered
The reason for the refund request
Any suspected fraud or misuse
Any rights you may have under applicable consumer protection laws

9) Acceptable use
You agree not to:
Use the Services for unlawful, harmful, or abusive activities
Harass, threaten, shame, or discriminate against others
Share content that is hateful, violent, sexually exploitative, or otherwise inappropriate
Attempt to access accounts, data, or systems you do not have permission to access
Reverse engineer, scrape, or disrupt the Services
Upload malware or malicious code
Misrepresent your identity or qualifications (including pretending to be a Coach)
We may suspend or terminate access if we reasonably believe you have violated these Terms.
10) Community rules and moderation
If community features are available:
You are responsible for what you post.
We may remove content or restrict accounts to keep the community safe and functional.
We do not guarantee that all harmful content will be identified or removed immediately.
11) Your content, testimonials, and permissions
You may submit content such as responses, messages, reviews, testimonials, or profile information (“User Content”).
You:
Confirm you have the rights to submit User Content.
Grant TFM a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and use your User Content to operate and improve the Services.
Testimonials and marketing: If you submit a testimonial/review, you give us permission to use it for marketing (for example on the website or social media), including your first name and/or profile photo if you provide them, unless you ask us not to.
You can request removal of a testimonial by emailing thefutureme2026@gmail.com. We will make reasonable efforts to remove it going forward, but it may remain in past materials already published.
12) Intellectual property
TFM and its content (including branding, designs, templates, text, scores, logic, and materials) are owned by TFM or its licensors and protected by intellectual property laws.
You may not copy, modify, resell, distribute, or create derivative works from our content unless we explicitly allow it.
Licence to you
We grant you a limited, personal, non-transferable, non-exclusive licence to access and use the Services for your personal use (or internal use if you purchase a business plan, if offered).
13) Privacy
Our Privacy Policy explains how we collect, use, and share personal data. By using the Services, you acknowledge the Privacy Policy.
14) Third-party links and platforms
The Services may integrate with or link to third-party platforms (for example analytics, ads, payment providers, video call tools).
We are not responsible for third-party services, their content, or their policies. Your use of third-party services is governed by their own terms.
15) Service availability and changes
We try to keep the Services available, but we do not guarantee uninterrupted access. We may change, suspend, or discontinue parts of the Services at any time.
16) Termination
You may stop using the Services at any time.
We may suspend or terminate your access if:
You breach these Terms
We believe your use creates risk or legal exposure
We are required to do so by law
Termination may limit your access to content, community features, or purchase history, subject to legal obligations.
17) Disclaimers
To the maximum extent permitted by law:
The Services are provided “as is” and “as available”.
We do not make warranties that the Services will be error-free, accurate, or that any outcomes will be achieved.
You use the Services at your own risk.
18) Limitation of liability
To the maximum extent permitted by law:
TFM will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
TFM’s total liability for any claim relating to the Services is limited to the amount you paid to TFM (if any) in the 12 months before the event giving rise to the claim, or USD $50 if you paid nothing, unless applicable law requires otherwise.
Nothing in these Terms limits liability where it cannot be limited under law.
19) Indemnity
You agree to indemnify and hold harmless TFM from claims, damages, liabilities, and expenses arising from:
Your misuse of the Services
Your violation of these Terms
Your User Content
Your interactions with Coaches or other users
20) Disputes, governing law, and venue
These Terms are governed by the laws of South Africa, without regard to conflict of law rules.
You agree that disputes will be brought in the courts of South Africa, unless mandatory consumer protection laws in your country say otherwise.
